Indian Industries Association (IIA) termed the decision of Government of Uttar Pradesh for implementing e-Way Bill under GST as a decision taken in haste.
IIA also opposed the decision of applicability of e-Way Bill system on the goods valuing less than Rs 50000/- as provided in the GST Rules and guidelines of the CBEC. Government of U.P has ordered implementation of e-Way Bill for movement of Goods valuing Rs5000/- and more which is ten times less than provided in the rules..
President IIA submitted the protest / representations to Chairman GST Council , Government of India, Minister Finance Government of U.P, Additional Chief secretary, Institutional Finance , Tax & registration , Govt. of U.P as well as to Commissioner, State Taxes / Commercial Tax Govt. of U.P in this regard today.
In his letters President IIAhave urged the Government not to implement the e-Way Bill system before October 2017 in accordance with the assurance given by Government of India before implementation of GST. Most of the Small industry owner at present are grappling with the complexities and procedures to implement the GST as well as to understand it. As a result their business is already hampered as on date. Under this situation loading them with another burden of e-way bill that too when Government itself is not prepared for it will push their business further down.
Reducing the value of Goods applicable for movement of goods under e-Way Bill from Rs 50000/ to Rs 5000/- is also against the spirit of GST and violation of the Rules itself.
In the recent past Government of U.P assured that S.I.B surveys and seizers will be stopped for three months after implementation of GST to give space to the businessmen to migrate smoothly to the new Taxation System. IIA welcomed this decision. But with the implementation of e-Way bill, these seizers will start automatically . Hence the businessmen of the state will loose their faith on the Government decisions with the implementation of e-Way bill.
Though the e-Way bill system under GST has been implemented from today yet the software and the associated systems for it are not in place either at Government of India or at State level. As such implementing the old system as it is like putting Old Wine in a New Bottle. This is not desirable said Mr Vaish , President IIA.
President IIA in his letter written to Chairman GST Council Government of India have urged him to advise the State Government to postpone the implementation of E-Way Bill till October 2017 and not to reduce the value of goods for e-way bill from Rs 50000 to Rs 5000.
